Terms for Business Accounts

Terms for business accounts of MusicHeartsFM: venues, promoters and artists

Last Updated: October 2026 · Version 2026-10-25

These Terms for Business Accounts (the "Business Terms") govern the use of the business features of MusicHeartsFM by venues, clubs, promoters, artists, bands and other professional users. They supplement the general Terms of Use and the Privacy Policy. Where they conflict with the general Terms of Use on a matter concerning business features, these Business Terms prevail.

1. Provider

The business features are provided by Aleksei Melikhov, registered self-employed professional (autónomo) in Spain, Alicante (the "Provider", "we", "us"). Contact: [email protected].

2. Acceptance and capacity

You accept these Business Terms by ticking the acceptance box when you submit a claim for a venue, accept an invitation or access link to a business account, create an artist or band profile, or otherwise start using the business features. We record the version of the Business Terms you accepted and the date and time of acceptance.

By accepting, you confirm that:

  • you are of legal age and have full capacity to enter into this agreement;

  • you use the business features for purposes related to your trade, business, craft or profession, and not as a consumer;

  • where you act on behalf of a venue, company, band or other organisation (the "Business"), you are duly authorised to bind it, and the Business is bound by these Business Terms. References to "you" include the Business.

3. Definitions

  • Business account — the account of a Business on MusicHeartsFM, with its members, plan and settings.

  • Venue profile — the public page of a venue on MusicHeartsFM. It may exist before any claim, compiled from public sources and partner data (for example, ticketing partners).

  • Claim — a request to manage a venue profile on behalf of the venue.

  • Member — a user given access to a business account, with the role of owner, manager or viewer.

  • Business content — any information, text, images, logos, events, dates, conditions and other materials that you or your members submit through the business features.

4. Claims and verification

4.1. Only persons authorised by the venue may claim its profile. We may verify a claim by any reasonable means, including correspondence with the official contact details of the venue, a phone call, a code or a link sent to an official email address, or a request for documents.

4.2. We may accept or reject a claim at our discretion, in particular where authority cannot be confirmed or where several persons claim the same venue. A venue profile is managed by one business account at a time.

4.3. An approved claim gives the right to manage the venue profile through the business features. It does not transfer to you any ownership of the profile, its URL or the platform, and it does not oblige us to remove the profile. If the claim ends, the profile may remain public with information from public sources.

4.4. We may revoke an approved claim if the authority turns out to be absent or no longer exists, if we receive a well-founded objection from the venue or its legal representative, or in the cases described in section 13.

5. Business account and members

5.1. The owner of a business account may invite members and assign them roles. The Business is responsible for all actions performed through its business account, including by its members, and must remove access of persons who are no longer authorised.

5.2. Access credentials and access links sent by us are personal. You must keep them confidential, must not forward them, and must notify us without delay of any unauthorised use at [email protected].

6. Business content

6.1. You are responsible for the business content and warrant that it is accurate, up to date and lawful, and that you hold all rights and consents necessary to publish it, including rights to images, logos, trademarks and the names of artists.

6.2. You grant us a non-exclusive, worldwide, royalty-free licence, for the duration of the business account and a reasonable period afterwards needed to remove the content, to host, reproduce, display, adapt to formats and devices, and translate the business content (including by automated means), and to make it available on MusicHeartsFM, in its widgets, feeds and calendar links, and in sharing previews on third-party platforms, for the purpose of operating and promoting the Service. You retain all rights to your business content.

6.3. Business content is public unless the feature states otherwise (for example, internal notes in the calendar). Do not publish personal data of third parties, such as the private phone number or personal email of an employee, unless you have a legal basis to do so. Contact details you enter for the venue are shown to the public.

6.4. Automatic translations are provided for convenience and may contain errors. You can review and correct the text in each language.

6.5. We may moderate, correct obvious errors in, hide or remove business content that breaches these Business Terms or the law, that is misleading, or that is the subject of a well-founded complaint. Where reasonable, we will inform you of the reason.

7. Events and calendar

7.1. You may publish events of your venue. You are the organiser of such events or act on behalf of their organiser. You must keep event information accurate and promptly update or unpublish events that are cancelled or changed.

7.2. MusicHeartsFM is an information service. We are not the organiser of events and are not responsible for their holding, content, safety, or for the sale, delivery or refund of tickets, which is carried out by you or by third-party ticket sellers.

7.3. Events about your venue may also come from public sources and partners. We may combine, correct or hide duplicate or inaccurate events.

8. Booking applications

8.1. The booking features let artists and bands send performance applications to venues and let venues answer them. MusicHeartsFM only provides the tool for this exchange. We are not a party to any agreement between a venue and an artist, do not act as an agent or promoter, and do not guarantee that any application will be answered or any performance will take place.

8.2. Each party that receives the other's data through an application (for example, a band's contacts and materials, or a venue's conditions) becomes an independent data controller of that data. It may use it only to assess and organise the performance and must comply with data protection law. Sending unsolicited advertising through applications is forbidden.

9. Plans, pilot and fees

9.1. The business features are offered under plans (for example, Free, Free Pilot and paid plans). The features and limits of each plan are shown in the business account.

9.2. The Free Pilot plan, where granted, is free of charge, is valid for the period stated when it is granted and gives additional features for testing. When the pilot ends, the business account moves to the Free plan unless you choose another plan. No fee is charged unless you expressly order a paid plan or service.

9.3. Paid plans and services, where offered, are subject to the price, billing period and conditions shown when ordering or agreed in writing (including by invoice). Prices are stated exclusive of VAT unless indicated otherwise. Payments by card are processed by our payment provider.

9.4. We may change or discontinue free plans and features. We will inform you at least 30 days in advance of a change that materially reduces the features of your current plan, except where the change is required by law, security or third-party providers.

10. Statistics

Statistics shown in the business account (views, clicks, audience) are estimates based on our measurement, exclude detected automated traffic and are provided for information only. They are shown in aggregated form and do not include personal data of visitors. We do not guarantee any level of audience, traffic, ticket sales or revenue.

11. Acceptable use

You must not:

  • claim a venue or create a profile without authority, or impersonate another person or organisation;

  • publish false, misleading or fictitious events, dates, conditions or reviews;

  • use the business features to send spam or unsolicited communications;

  • collect data of other users or artists for purposes other than the specific exchange for which it was provided;

  • circumvent plan limits, access controls or security measures, or use automated means to access the business features beyond those we provide;

  • use the Service in breach of the law or rights of third parties.

12. Communications

We will send you service communications about your business account by email and in-app notifications, such as messages about claims, invitations, applications, plan changes and security. These communications are part of the service. We will send you commercial communications only if you have consented to them, and you can withdraw your consent at any time.

13. Suspension and termination

13.1. You may stop using the business features at any time: withdraw a claim, give up a venue, leave a business account or request deletion of your account at [email protected].

13.2. We may suspend or restrict a business account, revoke a claim or terminate access, with notice where reasonable, if you breach these Business Terms or the law, if verification fails, if there is a security risk, or if required by a competent authority. In case of serious breach, we may do so without prior notice.

13.3. After termination, we may keep data as described in the Privacy Policy, and the venue profile may remain public as described in section 4.3.

14. Liability

14.1. The business features are provided "as is" and "as available". We do not guarantee uninterrupted or error-free operation, in particular where it depends on third-party providers.

14.2. To the extent permitted by law, we are not liable for indirect or consequential damage, loss of profit, revenue, audience or data, or for the content and acts of other users, artists, venues and third parties.

14.3. Our total liability arising from the business features is limited to the amount you paid us for them in the 12 months preceding the event giving rise to the claim; for free plans, to one hundred euros (EUR 100).

14.4. Nothing in these Business Terms limits liability for wilful misconduct or gross negligence, or any other liability that cannot be limited under applicable law.

15. Indemnity

You will indemnify and hold us harmless from claims of third parties, including reasonable legal costs, arising from your business content or from your breach of these Business Terms or of the law.

16. Data protection

We process personal data of the persons who use business accounts as controller, as described in the Privacy Policy (section «Business accounts»). When you receive personal data of other users through the business features (for example, booking applications), section 8.2 applies.

17. Changes

We may amend these Business Terms. We will inform you of material changes by email or in the business account at least 15 days before they take effect. If you do not agree, you may stop using the business features before the effective date. Continued use after that date means acceptance of the new version, and we may also ask you to accept it expressly.

18. Language, governing law and jurisdiction

These Business Terms are available in Spanish, English and Russian. In case of discrepancy, the Spanish version prevails. They are governed by Spanish law. For any dispute, the parties submit to the courts of the city of Alicante (Spain), unless mandatory law provides otherwise.
